Welcome to the website of Summit’s Healthcare, LLC (“we,” “us,” or “our”). By accessing or using summitshealth.com (the “Site”) or our physical and virtual clinic services, you agree to comply with and be bound by the following Terms of Service. Please read them carefully.

1. Medical Services and Telehealth

  • Eligibility: You must be 18 years of age or older to create an account or request telehealth services independently. Legal guardians must manage care for patients under 18.
  • Telehealth Limitations: Telehealth involves the delivery of healthcare services using electronic communications. While highly effective, it has limitations compared to in-person care. If our providers determine your condition requires an in-person physical exam or emergency intervention, we reserve the right to direct you to our physical clinic or a local emergency room.
  • No Emergency Services: DO NOT USE THIS SITE OR OUR TELEHEALTH SERVICES FOR MEDICAL EMERGENCIES. If you are experiencing a medical emergency, call emergency services immediately or go to the nearest emergency room.

2. PracticeQ Platform and Accounts

We utilize PracticeQ as our secure Electronic Health Record (EHR) and patient scheduling portal.

  • You are responsible for providing accurate, current, and complete health history information during your intake process.
  • You are responsible for maintaining the confidentiality of any patient portal login credentials you create.

3. Payments, Cancellations, and No-Show Fees

  • Billing: By scheduling an appointment or purchasing a service, you authorize Summit’s Healthcare, LLC (and our third-party payment processors) to charge your designated payment method.
  • Insurance Boundaries: You are responsible for providing accurate, active insurance details. Any costs, co-pays, deductibles, or non-covered services not reimbursed by your commercial insurance provider remain your out-of-pocket financial responsibility.
  • Cancellation Window: We require at least 24 hours’ notice for cancellations or rescheduling.
  • Commercial and Self-Pay No-Show Fees: Patients using commercial insurance or paying cash who fail to show up for an appointment, or who cancel with less than 24 hours’ notice, will be charged a $35 no-show fee. This fee cannot be billed to your health insurance company and must be paid out-of-pocket before your next appointment.
  • Medicaid Patient Policy: In strict compliance with federal and state regulations, no-show and cancellation fees do not apply to patients covered by Medicaid. However, to maintain high quality-of-care availability for the Deming community, excessive missed appointments (three or more consecutive no-shows) without communication may result in administrative review or discharge from the practice.

4. Prohibited Uses

You agree not to use the Site or our services to:

  • Provide fraudulent, misleading, or inaccurate health data.
  • Impersonate any individual or entity.
  • Attempt to bypass or compromise the security architecture of the Site or the PracticeQ platform.
  • Harvest or collect personal info or data belonging to other patients.

5. Limitation of Liability

To the maximum extent permitted by law, Summit’s Healthcare, LLC and its clinical providers, employees, or contractors shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the website or telehealth connectivity issues.

6. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Any changes will be posted on this page with an updated “Effective Date.” Your continued use of our Site or services after changes are posted constitutes your acceptance of the updated terms.

7. Governing Law

These Terms of Service and any disputes arising from your use of our services are governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles.
